Source text - Indonesian PERATURAN PEMERINTAH REPUBLIK INDONESIA NOMOR 22 TAHUN 2008 TENTANG PENDANAAN DAN PENGELOLAAN BANTUAN BENCANA DENGAN RAHMAT TUHAN YANG MAHA ESA PRESIDEN REPUBLIK INDONESIA, Menimbang : bahwa untuk melaksanakan ketentuan Pasal 63 dan Pasal 69 ayat (4) Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana perlu menetapkan Peraturan Pemerintah tentang Pendanaan dan Pengelolaan Bantuan Bencana; Mengingat : 1. Pasal 5 ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945; 2. Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana (Lembaran Negara Republik Indonesia Tahun 2007 Nomor 66, Tambahan Lembaran Negara Republik Indonesia Nomor 4723); MEMUTUSKAN: Menetapkan : PERATURAN PEMERINTAH TENTANG PENDANAAN DAN PENGELOLAAN BANTUAN BENCANA. BAB I KETENTUAN UMUM Pasal 1 Dalam Peraturan Pemerintah ini yang dimaksud dengan: 1. Dana penanggulangan bencana adalah dana yang digunakan bagi penanggulangan bencana untuk tahap prabencana, saat tanggap darurat, dan/atau pascabencana. 2. Anggaran Pendapatan dan Belanja Negara, selanjutnya disebut APBN, adalah rencana keuangan tahunan pemerintahan negara yang disetujui oleh Dewan Perwakilan Rakyat. 3. Anggaran . . . - 2 - 3. Anggaran Pendapatan dan Belanja Daerah, selanjutnya disebut APBD, adalah rencana keuangan tahunan pemerintahan daerah yang disetujui oleh Dewan Perwakilan Rakyat Daerah. 4. Dana kontinjensi bencana adalah dana yang dicadangkan untuk menghadapi kemungkinan terjadinya bencana tertentu. 5. Dana siap pakai adalah dana yang selalu tersedia dan dicadangkan oleh Pemerintah untuk digunakan pada saat tanggap darurat bencana sampai dengan batas waktu tanggap darurat berakhir. 6. Dana bantuan sosial berpola hibah adalah dana yang disediakan Pemerintah kepada pemerintah daerah sebagai bantuan penanganan pascabencana. 7. Bantuan darurat bencana adalah bantuan untuk memenuhi kebutuhan dasar pada saat tanggap darurat. 8. Penyelenggaraan penanggulangan bencana adalah serangkaian upaya yang meliputi penetapan kebijakan pembangunan yang berisiko timbulnya bencana, kegiatan pencegahan bencana, tanggap darurat, dan rehabilitasi. 9. Badan Nasional Penanggulangan Bencana yang selanjutnya disingkat dengan BNPB adalah lembaga pemerintah non-departemen sesuai dengan ketentuan peraturan perundang-undangan. 10. Badan Penanggulangan Bencana Daerah yang selanjutnya disingkat BPBD adalah badan pemerintah daerah yang melakukan penyelenggaraan penanggulangan bencana. 11. Instansi/lembaga terkait adalah instansi/lembaga yang terkait dengan penanggulangan bencana. Pasal 2 Pendanaan dan pengelolaan bantuan bencana ditujukan untuk mendukung upaya penanggulangan bencana secara berdayaguna, berhasilguna, dan dapat dipertanggungjawabkan. Pasal 3 . . . - 3 - Pasal 3 Pengaturan pendanaan dan pengelolaan bantuan bencana meliputi: a. sumber dana penanggulangan bencana; b. penggunaan dana penanggulangan bencana; c. pengelolaan bantuan bencana; dan d. pengawasan, pelaporan, dan pertanggungjawaban pendanaan dan pengelolaan bantuan bencana. BAB II SUMBER DANA PENANGGULANGAN BENCANA Pasal 4 (1) Dana penanggulangan bencana menjadi tanggungjawab bersama antara Pemerintah dan pemerintah daerah. (2) Dana penanggulangan bencana sebagaimana dimaksud pada ayat (1) berasal dari: a. APBN; b. APBD; dan/atau c. masyarakat. Pasal 5 (1) Pemerintah dan pemerintah daerah mengalokasikan anggaran penanggulangan bencana dalam APBN dan APBD sebagaimana dimaksud dalam Pasal 4 ayat (2) huruf a dan huruf b secara memadai. (2) Anggaran sebagaimana dimaksud pada ayat (1) disediakan pada tahap prabencana, saat tanggap darurat bencana, dan pascabencana. (3) Dalam anggaran penanggulangan bencana yang bersumber dari APBN sebagaimana dimaksud pada ayat (1), Pemerintah menyediakan pula: a. dana kontinjensi bencana; b. dana siap pakai; dan c. dana bantuan sosial berpola hibah. Pasal 6 . . . - 4 - Pasal 6 (1) Dana kontinjensi bencana sebagaimana dimaksud dalam Pasal 5 ayat (3) huruf a disediakan dalam APBN untuk kegiatan kesiapsiagaan pada tahap prabencana. (2) Dana siap pakai sebagaimana dimaksud dalam Pasal 5 ayat (3) huruf b disediakan dalam APBN yang ditempatkan dalam anggaran BNPB untuk kegiatan pada saat tanggap darurat. (3) Pemerintah daerah dapat menyediakan dana siap pakai dalam anggaran penanggulangan bencana yang berasal dari APBD yang ditempatkan dalam anggaran BPBD. (4) Dana siap pakai sebagaimana dimaksud pada ayat (2) harus selalu tersedia sesuai dengan kebutuhan pada saat tanggap darurat. (5) Dana bantuan sosial berpola hibah sebagaimana dimaksud dalam Pasal 5 ayat (2) huruf c disediakan dalam APBN untuk kegiatan pada tahap pascabencana. Pasal 7 (1) Pemerintah dan pemerintah daerah mendorong partisipasi masyarakat dalam penyediaan dana yang bersumber dari masyarakat sebagaimana dimaksud dalam Pasal 4 ayat (2) huruf c. (2) Dana yang bersumber dari masyarakat sebagaimana dimaksud pada ayat (1) yang diterima oleh Pemerintah dicatat dalam APBN. (3) Dana yang bersumber dari masyarakat sebagaimana dimaksud pada ayat (1) yang diterima oleh pemerintah daerah dicatat dalam APBD. (4) Pemerintah daerah hanya dapat menerima dana yang bersumber dari masyarakat dalam negeri. (5) Ketentuan lebih lanjut mengenai pencatatan dana sebagaimana dimaksud pada ayat (2) diatur dengan Peraturan Menteri Keuangan. (6) Ketentuan . . . - 5 - (6) Ketentuan lebih lanjut mengenai pencatatan dana sebagaimana dimaksud pada ayat (3) diatur dengan Peraturan Menteri Dalam Negeri. Pasal 8 Dalam mendorong partisipasi masyarakat sebagaimana dimaksud dalam Pasal 7, Pemerintah atau pemerintah daerah dapat: a. memfasilitasi masyarakat yang akan memberikan bantuan dana penanggulangan bencana; b. memfasilitasi masyarakat yang akan melakukan pengumpulan dana penanggulangan bencana; dan c. meningkatkan kepedulian masyarakat untuk berpartisipasi dalam penyediaan dana. Pasal 9 (1) Setiap pengumpulan dana penanggulangan bencana, wajib mendapat izin dari instansi/lembaga yang berwenang. (2) Setiap izin yang diberikan oleh instansi/lembaga sebagaimana dimaksud pada ayat (1) salinannya disampaikan kepada BNPB atau BPBD. (3) Tata cara perizinan pengumpulan dana penanggulangan bencana dilakukan sesuai dengan ketentuan peraturan perundang-undangan. BAB III PENGGUNAAN DANA PENANGGULANGAN BENCANA Bagian Kesatu Umum Pasal 10 (1) Penggunaan dana penanggulangan bencana dilaksanakan oleh Pemerintah, pemerintah daerah, BNPB, dan/atau BPBD sesuai dengan tugas pokok dan fungsinya. (2) Dana . . . - 6 - (2) Dana penanggulangan bencana digunakan sesuai dengan penyelenggaraan penanggulangan bencana yang meliputi tahap prabencana, saat tanggap darurat, dan/atau pascabencana sebagaimana dimaksud dalam Pasal 6. Bagian Kedua Prabencana Pasal 11 Perencanaan, penganggaran, pelaksanaan, pelaporan, dan pertanggungjawaban penggunaan dana penanggulangan bencana yang bersumber dari APBN atau APBD pada tahap prabencana dilakukan sesuai dengan ketentuan peraturan perundang-undangan. Pasal 12 Dana penanggulangan bencana pada tahap prabencana dialokasikan untuk kegiatan dalam situasi: a. tidak terjadi bencana; dan b. terdapat potensi terjadinya bencana. Pasal 13 Penggunaan dana penanggulangan bencana dalam situasi tidak terjadi bencana sebagaimana dimaksud dalam Pasal 12 huruf a meliputi: a. fasilitasi penyusunan rencana penanggulangan bencana; b. program pengurangan risiko bencana; c. program pencegahan bencana; d. pemaduan perencanaan pembangunan dengan perencanaan penanggulangan bencana; e. penyusunan analisis risiko bencana; f. fasilitasi pelaksanaan dan penegakan rencana tata ruang; g. penyelenggaraan . . . - 7 - g. penyelenggaraan pendidikan dan pelatihan penanggulangan bencana; dan h. penyusunan standar teknis penanggulangan bencana. Pasal 14 (1) Penggunaan dana penanggulangan bencana dalam situasi terdapat potensi terjadinya bencana sebagaimana dimaksud dalam Pasal 12 huruf b meliputi: a. kegiatan kesiapsiagaan; b. pembangunan sistem peringatan dini; dan c. kegiatan mitigasi bencana. (2) Kegiatan kesiapsiagaan sebagaimana dimaksud pada ayat (1) huruf a menggunakan dana kontinjensi sebagaimana dimaksud dalam Pasal 5 ayat (3) huruf a. Bagian Ketiga Tanggap Darurat Bencana Pasal 15 (1) Dana penanggulangan bencana yang digunakan pada saat tanggap darurat meliputi: a. dana penanggulangan bencana yang telah dialokasikan dalam APBN atau APBD untuk masingmasing instansi/lembaga terkait; b. dana siap pakai sebagaimana dimaksud dalam Pasal 5 ayat (3) huruf b yang dialokasikan dalam anggaran BNPB; dan c. dana siap pakai yang telah dialokasikan pemerintah daerah dalam anggaran BPBD. (2) BNPB atau BPBD sesuai dengan kewenangannya mengarahkan penggunaan dana penanggulangan bencana sebagaimana dimaksud pada ayat (1) huruf a. Pasal 16 . . . - 8 - Pasal 16 Penggunaan dana penanggulangan bencana pada saat tanggap darurat sebagaimana dimaksud dalam Pasal 15 ayat (1) huruf a meliputi: a. pelaksanaan pengkajian secara cepat dan tepat terhadap lokasi, kerusakan, dan sumber daya; b. kegiatan penyelamatan dan evakuasi masyarakat terkena bencana; c. pemberian bantuan pemenuhan kebutuhan dasar korban bencana; d. pelaksanaan perlindungan terhadap kelompok rentan; dan e. kegiatan pemulihan darurat prasarana dan sarana. Pasal 17 (1) Dana siap pakai sebagaimana dimaksud dalam Pasal 15 ayat (1) huruf b digunakan sesuai dengan kebutuhan tanggap darurat bencana. (2) Penggunaan dana siap pakai terbatas pada pengadaan barang dan/atau jasa untuk: a. pencarian dan penyelamatan korban bencana; b. pertolongan darurat; c. evakuasi korban bencana; d. kebutuhan air bersih dan sanitasi; e. pangan; f. sandang; g. pelayanan kesehatan; dan h. penampungan serta tempat hunian sementara. (3) Penggunaan dana siap pakai dilaksanakan berdasarkan pedoman yang ditetapkan oleh Kepala BNPB. Pasal 18 Dalam hal pemerintah daerah mengalokasikan dana siap pakai dalam anggaran BPBD, pengaturan penggunaan dana siap pakai berlaku mutatis mutandis Pasal 17. Bagian Keempat . . . - 9 - Bagian Keempat Pascabencana Pasal 19 Perencanaan, penganggaran, pelaksanaan, pelaporan, dan pertanggungjawaban penggunaan dana penanggulangan bencana yang bersumber dari APBN dan APBD pada tahap pascabencana dilakukan sesuai dengan ketentuan peraturan perundang-undangan. Pasal 20 Dana penanggulangan bencana dalam tahap pascabencana digunakan untuk kegiatan: a. rehabilitasi; dan b. rekonstruksi. Pasal 21 Kegiatan rehabilitasi sebagaimana dimaksud dalam Pasal 20 huruf a meliputi: a. perbaikan lingkungan daerah bencana; b. perbaikan prasarana dan sarana umum; c. pemberian bantuan perbaikan rumah masyarakat; d. pemulihan sosial psikologis; e. pelayanan kesehatan; f. rekonsiliasi dan resolusi konflik; g. pemulihan sosial ekonomi budaya; h. pemulihan keamanan dan ketertiban; i. pemulihan fungsi pemerintahan; atau j. pemulihan fungsi pelayanan publik. Pasal 22 . . . - 10 - Pasal 22 Kegiatan rekonstruksi sebagaimana dimaksud dalam Pasal 20 huruf b meliputi: a. pembangunan kembali prasarana dan sarana; b. pembangunan kembali sarana sosial masyarakat; c. pembangkitan kembali kehidupan sosial budaya masyarakat; d. penerapan rancang bangun yang tepat dan penggunaan peralatan yang lebih baik dan tahan bencana; e. partisipasi dan peran serta lembaga dan organisasi kemasyarakatan, dunia usaha dan masyarakat; f. peningkatan kondisi sosial, ekonomi, dan budaya; g. peningkatan fungsi pelayanan publik; atau h. peningkatan pelayanan utama dalam masyarakat. Pasal 23 (1) Pemerintah dapat memberikan bantuan untuk pembiayaan pascabencana kepada pemerintah daerah yang terkena bencana berupa dana bantuan sosial berpola hibah sebagaimana dimaksud dalam Pasal 5 ayat (3) huruf c. (2) Untuk memperoleh bantuan sebagaimana dimaksud pada ayat (1), pemerintah daerah mengajukan permohonan tertulis kepada Pemerintah melalui BNPB. (3) Berdasarkan permohonan tertulis sebagaimana dimaksud pada ayat (2), BNPB melakukan evaluasi, verifikasi, dan mengkoordinasikannya dengan instansi/lembaga terkait. (4) Hasil evaluasi dan verifikasi sebagaimana dimaksud pada ayat (3) ditetapkan oleh Kepala BNPB dan disampaikan kepada Menteri Keuangan untuk selanjutnya diajukan kepada Dewan Perwakilan Rakyat untuk mendapatkan persetujuan penggunaan dana bantuan sosial berpola hibah. BAB IV . . . - 11 - BAB IV PENGELOLAAN BANTUAN BENCANA Bagian Kesatu Umum Pasal 24 (1) Pemerintah dan pemerintah daerah menyediakan dan memberikan bantuan bencana kepada korban bencana. (2) Bantuan bencana sebagaimana dimaksud pada ayat (1) terdiri dari: a. santunan duka cita; b. santunan kecacatan; c. pinjaman lunak untuk usaha produktif; dan d. bantuan pemenuhan kebutuhan dasar. Bagian Kedua Santunan Duka Cita Pasal 25 (1) Santunan duka cita sebagaimana dimaksud dalam Pasal 24 ayat (2) huruf a diberikan kepada korban meninggal dalam bentuk: a. biaya pemakaman; dan/atau b. uang duka. (2) Santunan duka cita sebagaimana dimaksud pada ayat (1), diberikan setelah dilakukan pendataan, identifikasi, dan verifikasi oleh instansi/lembaga yang berwenang yang dikoordinasikan oleh BNPB atau BPBD sesuai dengan kewenangannya. (3) Santunan duka cita sebagaimana dimaksud pada ayat (2) diberikan kepada ahli waris korban. (4) Ketentuan lebih lanjut mengenai pemberian dan besaran bantuan santunan duka cita sebagaimana dimaksud pada ayat (3) diatur dengan peraturan Kepala BNPB setelah mendapat persetujuan Menteri Keuangan. Bagian Ketiga . . . - 12 - Bagian Ketiga Santunan Kecacatan Pasal 26 (1) Santunan kecacatan sebagaimana dimaksud dalam Pasal 24 ayat (2) huruf b diberikan kepada korban bencana yang mengalami kecacatan mental dan/atau fisik. (2) Santunan kecacatan sebagaimana dimaksud pada ayat (1), diberikan setelah dilakukan pendataan, identifikasi, dan verifikasi oleh instansi/lembaga yang berwenang yang dikoordinasikan oleh BNPB atau BPBD sesuai dengan kewenangannya. (3) Ketentuan lebih lanjut mengenai pemberian dan besaran bantuan santunan kecacatan sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Kepala BNPB setelah mendapat persetujuan Menteri Keuangan. Bagian Keempat Pinjaman Lunak untuk Usaha Produktif Pasal 27 (1) Pinjaman lunak untuk usaha produktif diberikan kepada korban bencana yang kehilangan mata pencaharian. (2) Pinjaman lunak untuk usaha produktif sebagaimana dimaksud pada ayat (1) diberikan dalam bentuk: a. kredit usaha produktif; atau b. kredit pemilikan barang modal. (3) Pinjaman lunak sebagaimana dimaksud pada ayat (2), diberikan setelah dilakukan pendataan, identifikasi, dan verifikasi oleh instansi/lembaga yang berwenang yang dikoordinasikan oleh BNPB atau BPBD sesuai dengan kewenangannya. (4) Ketentuan lebih lanjut mengenai pemberian dan besaran pinjaman lunak sebagaimana dimaksud pada ayat (2) diatur dengan Peraturan Kepala BNPB setelah mendapat persetujuan Menteri Keuangan. Bagian Kelima . . . - 13 - Bagian Kelima Bantuan Pemenuhan Kebutuhan Dasar Pasal 28 (1) Bantuan pemenuhan kebutuhan dasar sebagaimana dimaksud dalam Pasal 24 ayat (2) huruf d diberikan kepada korban bencana dalam bentuk: a. penampungan sementara; b. bantuan pangan; c. sandang; d. air bersih dan sanitasi; dan e. pelayanan kesehatan. (2) Bantuan darurat bencana untuk pemenuhan kebutuhan dasar korban bencana diberikan dengan memperhatikan standar minimal kebutuhan dasar dengan memperhatikan prioritas kepada kelompok rentan. (3) Ketentuan lebih lanjut mengenai tata cara pemberian bantuan pemenuhan kebutuhan dasar sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Kepala BNPB. Bagian Keenam Pengelolaan dan Pertanggungjawaban Bantuan Pasal 29 (1) BNPB berwenang mengkoordinasikan pengendalian, pengumpulan, dan penyaluran bantuan darurat bencana pada tingkat nasional. (2) BPBD berwenang mengkoordinasikan pengendalian, pengumpulan dan penyaluran bantuan darurat bencana pada tingkat daerah. Pasal 30 (1) Tata cara pengelolaan serta pertanggungjawaban penggunaan bantuan darurat bencana diberikan perlakuan khusus sesuai dengan kebutuhan, situasi, dan kondisi kedaruratan. (2) Ketentuan . . . - 14 - (2) Ketentuan lebih lanjut mengenai tata cara pengelolaan serta pertanggungjawaban penggunaan bantuan darurat bencana sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Kepala BNPB. BAB V PENGAWASAN DAN LAPORAN PERTANGGUNGJAWABAN Bagian Kesatu Umum Pasal 31 (1) Pemerintah, pemerintah daerah, BNPB atau BPBD sesuai dengan kewenangannya melaksanakan pengawasan dan laporan pertanggungjawaban terhadap pengelolaan dana dan bantuan penanggulangan bencana. (2) Instansi/lembaga terkait bersama BNPB atau BPBD melakukan pengawasan terhadap penyaluran bantuan dana yang dilakukan oleh masyarakat kepada korban bencana. Bagian Kedua Pengawasan Pasal 32 Pemerintah dan pemerintah daerah melaksanakan pengawasan terhadap pengelolaan dana dan bantuan pada seluruh tahapan penanggulangan bencana. Bagian Ketiga Laporan Pertanggungjawaban Pasal 33 Laporan pertanggungjawaban pelaksanaan penanggulangan bencana, baik keuangan maupun kinerja pada tahap prabencana dan pascabencana dilakukan sesuai dengan ketentuan peraturan perundang-undangan. Pasal 34 . . . - 15 - Pasal 34 (1) Pertanggungjawaban penggunaan dana penanggulangan bencana pada saat tanggap darurat bencana diperlakukan secara khusus sesuai dengan kondisi kedaruratan dan dilaksanakan sesuai dengan prinsip akuntabilitas dan transparansi. (2) Laporan pertanggungjawaban pelaksanaan penanggulangan bencana, baik keuangan maupun kinerja pada saat tanggap darurat dilaporkan paling lambat 3 (tiga) bulan setelah masa tanggap darurat. Pasal 35 (1) Pelaporan keuangan penanggulangan bencana yang bersumber dari APBN atau APBD dilakukan sesuai standar akuntansi pemerintahan. (2) Sistem akuntansi dana penanggulangan bencana yang bersumber dari masyarakat dilakukan sesuai pedoman yang ditetapkan oleh Menteri Keuangan. Pasal 36 Semua laporan pertanggungjawaban penanggulangan bencana, baik keuangan maupun kinerjanya, diaudit sesuai dengan peraturan perundang-undangan. BAB VI KETENTUAN PENUTUP Pasal 37 Peraturan Pemerintah ini mulai berlaku pada tanggal diundangkan. Di samping bencana alam Indonesia juga rawan terhadap bencana akibat ulah manusia. Hal ini disebabkan karena faktor letak geografis dan geologi serta demografi. Bencana mengakibatkan dampak terhadap kehilangan jiwa manusia, harta benda, dan kerusakan prasarana dan sarana. Kerugian harta benda dan prasarana dapat mencapai jumlah yang sangat besar dan diperlukan dana yang cukup besar pula untuk pemulihannya. Penanggulangan bencana merupakan suatu rangkaian kegiatan yang bersifat preventif, penyelamatan, dan rehabilitatif yang harus diselenggarakan secara koordinatif, komprehensif, serentak, cepat, tepat, dan akurat melibatkan lintas sektor dan lintas wilayah sehingga memerlukan koordinasi berbagai instansi terkait dengan penekanan pada kepedulian publik dan mobilisasi masyarakat. Seluruh sistem, pengaturan, organisasi, rencana dan program yang berkaitan dengan hal-hal inilah yang disebut penanggulangan bencana. Agar menjadi efektif, penanggulangan bencana harus melibatkan semua sektor, termasuk sektor non-pemerintah, sektor swasta dan masyarakat, melibatkan semua tingkatan masyarakat dari tingkat nasional tertinggi sampai ke desa terkecil. Guna menghindarkan dan mengurangi kerugian yang sangat besar, maka diperlukan upaya penanggulangan sejak dari pencegahan, mitigasi, tanggap darurat, rehabilitasi dan rekonstruksi. Untuk melakukan kegiatan-kegiatan tersebut, dibutuhkan dana penanggulangan bencana. Dengan telah disahkannya Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana, merupakan bukti satu langkah maju dalam hal upaya Pemerintah dalam menangani bencana. The ready to use fund is the fund that is always available and prepare by the Government for the disaster emergency alert use until the end of the emergency alert. 6. The social aid fund with the donor pattern is the fund that is prepared by the Government to the region government as the post-disaster handling aid. 7. The disaster emergency aid assistance is the aid to fulfill the basic need when the situation of the emergency alert. 8. The implementation of the disaster tackling is the series of effort that covers the development policy determining that will risk of the coming of the disaster, the disaster avoiding activities, the emergency alert, and the rehabilitation. 9. The Disaster Tackling National Board that later will be called BNPB is the non-department government institution suit with the policy determination. 10. Clause 7 (1) The central and region government supports the society participation on the fund preparation comes from the society as it meant in Clause 4 article (2) c alphabet. (2) The fund comes from the society as it meant in article (1) that the central government accept will be recorded in APBN. (3) The fund comes from the society as it meant in article (1) that the region government accept will be recorded in APBD. (4) The region government can accept only the fund comes from the society of its country. (5) The further determination about the fund recording as it meant in article (2) manages with the Minister of Monetary Regulation. (6) The further determination about the fund recording as it meant in article (3) manages with the Minister of National Affairs Regulation. Clause 8 In supporting the society participation as it meant in Clause 7, the Government or the region government is able to: a. To facilitate the society that will give the disaster tackling aid assistance; b. To facilitate the society awareness to participate in the disaster tackling fundraising; and c. To increase the society awareness to participate in the fundraising support. Clause 9 (1) Every the disaster tackling fundraising, it is an obligation to get the permission from the responsible institution. (2) Every permission that issued by the institution as it meant by the article (1) the copied sent to the BNPB or BPBD. (3) The custom of the disaster tackling fundraising permission is made appropriate with regulation. CHAPTER III THE USE OF THE DISASTER TACKLING FUND Part One General Clause 10 (1) The use of the disaster tackling fund by the central government, region government, BNPB, and/or BPBD appropriate with the main task and its function. (2) The Disaster tackling fund is use appropriate with the implementation of the disaster tackling that covers the pre-disaster stage, the emergency alert situation, and/or the post-disaster as it meant in Clause 6. Part two Predisaster Clause 11 The planning, budgeting, implementing, reporting, and the responsibility of the disaster tackling fund use come from the APBN or APBD in the pre-disaster stage is made appropriate with the determination of the policy. Clause 12 The disaster tackling fund in the pre-disaster stage allocates to the activities in the situation: a. When there is no disaster; and b. There is a possibility of the disaster may occur. The implementation of the recitation as fast and correct to the location, damage, and the resources; b. The saving and evacuating of the society as the disaster victim activities; c. The disaster victim basic needs fulfillment of the aid assistance; d. The protection implementation to the fragile group; and e. The media of the emergency recovery activities. Clause 17 (1) The ready to use fund as it meant in the clause 15 article (1) article b is use appropriate with the need of the disaster emergency alert. (2) The ready to use fund implementing restricts to the utilities and/or service implementation for: a. The searching and saving of the disaster victim; b. The emergency help; c. Disaster victim evacuating; d. The clean water and sanitation needs; e. Food necessities; f. Clothing necessities; g. The health services; and h. The temporary living place and the interception. (3) The ready to use fund is implementing based on the manual made by the head of the BNPB. Clause 18 In this case the region government is allocating the ready to use fund to the BPBD budget, the ready to use fund arrangement is valid mutatis mutandis in the clause 17 Part 4 Post-disaster Clause 19 The planning, budgeting, implementing, reporting, and the responsibility of the disaster tackling fund use comes from the APBN and APBD in the post-disaster stage is made appropriate with the determination of the regulation. Clause 20 The disaster tackling fund in the post-disaster stage is use for the activities: a. Rehabilitation; and b. Reconstruction. Clause 21 The rehabilitation activities as it meant in the clause 20 alphabet a covers: a. The disaster area environment recovery; b. The public facilities repairing; c. The people’s house reconstructing aid assistance; d. The psychological social recovery; e. The health service; f. The conflict resolution and reconciliation; g. The culture economic social recovery; h. The order and security recovery; i. The government function recovery; or j. The public service function recovery. Clause 22 The reconstruction activities as it meant in the clause 20 b alphabet covers: a. The reconstruction facilities; b. The reconstruction of the society social facilities; c. The resurrection of the society social culture life; d. The correct construction design implementation and the use of the better and firm to the disaster tools; e. The role and participation of the institution and the organization of the society, the business world and society; f. The social, economic, and culture condition improvement; g. The public service function improvement; or h. The main service improvement in the society. Clause 23 (1) The government is able to give the aid for the post-disaster funding to the disaster victim region government as the social aid assistance fund with the donor pattern as it meant in Clause 5 article (3) c alphabet. (2) To get the aid assistance as it meant in article (1), the region government is proposing the written proposal to the central government through BNPB. (3) Based on the written proposal as it meant in article (2), BNPB is evaluating, verification, and coordinating with the related institution. (4) The evaluation and verification result as it meant in article (3) is determined by the head of BNPB and report to the Monetary minister for later will propose to the Society Representatives Board to get the agreement of the social aid fund use with the donor pattern. CHAPTER IV THE DISASTER AID ASSISTANCE MANAGEMENT Part I General Clause 24 (1) The central and region government is serving and giving the disaster aid assistance to the disaster victim. (2) The disaster aid assistance as it meant in article (1) consist of: a. The condolences fund; b. The handicapped fund; c. The elastic loan for the productive business; and d. The basic necessities fulfillment aid assistance. Part Two The Condolences Fund Clause 25 (1) The condolences Fund as it meant in Clause 24 article (2) a alphabet is giving to the died victim such as: a. The funeral cost; and or b. The condolences fund. (2) The condolences fund as it meant in the article (1), is giving after the composing data, indentification, and verification by the authorized institution with the coordination by BNPB or BPBD with the proper authority. (3) The condolences fund as it meant in the article (2) is gave to the victim legacy inheritance. (4) The further determination about the giving and the amount of the condolences fund aid as it meant in article (3) is arranged by the regulation made by the head of BNPB after the permission of the Minister of Monetary. Third Part The Handicapped Fund Clause 26 (1) The handicapped fund as it meant in Clause 24 article (2) b alphabet gives to the disaster victim that got a mentally and/or physically handicapped. (2) The handicapped fund as it meant in article (1), gives after the data collecting, identification, and verification by the authorized institution with the coordination of BNPB or BPBD appropriate with the authority. (3) The further determination for the productive effort is giving to the disaster victim that has lost the job. Fourth Part The Elastic Loan for the Productive Effort Clause 27 (1) The elastic loan for the productive effort is giving to the disaster victim that has lost the job. (2) The elastic loan for the productive effort as it meant in article (1) is giving in: a.The productive effort credit; or b. The capital utilities belonging credit. (3) The elastic loan as it meant in article (2), is giving after the data collecting, identification, and verification by the authorized institution coordinated with the BNPB or BPBD appropriate with authority. (4) The further determination about the giving and the amount of the elastic loan as it meant in article (2) is arranged by the regulation made by the head of the BNPB after the permission of the Minister of Monetary. Fifth Part The basic necessities fulfillment aid assistance Clause 28 (1) The basic need necessities fulfillment aid assistance as it meant in Clause 24 article (2) d alphabet is giving to the disaster victim in: a.The temporary living place b. Food necessities; c. Clothing necessities; d. Clean water and sanitation; and e. The health service. (2) Disaster emergency aid assistance for the basic need necessities fulfillment for the disaster victim is giving by looking the minimal standard of the basic necessities by looking the priority to the fragile group. (3) The further determination about the way of giving the basic need necessities fulfillment aid assistance as it meant in article (1) that has been arranged by the head of BNPB regulation. Sixth Part The management and the Responsibility of the Aid Clause 29 (1) BNPB has the authority to coordinate the controlling, collecting, and distributing the disaster emergency aid in the national stage. (2) BPBD has the authority to coordinate the controlling , collecting, and distributing the disaster emergency aid in the region stage. Clause 30 (1) The way of management also the responsibility of the disaster emergency aid is giving to the special treatment appropriate with the need, situation, and the emergency condition. (2) The further determination about the way of management also the responsibility of the use of the disaster emergency aid as it meant in article (1) is arranged by the regulation made by the head of BNPB. CHAPTER V THE SURVEILLANCE AND THE RESPONSIBILITY REPORT First Part General Clause 31 (1) The central government, region government, BNPB, or BPBD appropriate with the authority by implementing the surveillance and the responsibility report to the fund management and the disaster tackling . (2) The related institution along with the BNPB or BPBD is implementing the surveillance to the aid assistance distribution by the society to the disaster victim. Second Part Surveillance Clause 32 The central and region government is implementing the surveillance to the fund and aid management to all of the stages of the disaster tackling. Third Part The Responsibility Report Clause 33 The responsibility report of the disaster tackling implementation, as well as the budgeting or the way of work in the stage of pre-disaster and post-disaster is made appropriate with the regulation determination. The lost of the wealth and the utilities can reach the amount of big scale and it needs the fund in great of amounts also for the recovery. The disaster tackling also the series of preventing, rescuing, and the rehabilitating that had to be implemented coordinatively, comprehensively, right away, fast, right to the point, and accurate by involving the sector and region crossing so it need the coordination from all of the related institution by pressing the public attention and the society mobility. All of the system, arrangement, organization, plan, and the program that has the relation with this things that later called the disaster tackling. So it can be effective, the disaster tackling so it is must involving all of the sectors, including the non-government sector, privet sector and the society, it is involving all of the society stages from the highest national stages to the smallest village. By avoiding and reducing the bigger lost, so it needs the effort of disaster tackling from prevention, mitigation, emergency alert, rehabilitation, and reconstruction. By the validation of the Policy Number 24 of the Year 2007 about the disaster tackling, is the one of the proof step forward of the government effort in overcoming the disaster. Source text - Indonesian PERATURAN PEMERINTAH REPUBLIK INDONESIA NOMOR 23 TAHUN 2008 TENTANG PERAN SERTA LEMBAGA INTERNASIONAL DAN LEMBAGA ASING NONPEMERINTAH DALAM PENANGGULANGAN BENCANA DENGAN RAHMAT TUHAN YANG MAHA ESA PRESIDEN REPUBLIK INDONESIA, Menimbang : bahwa untuk melaksanakan ketentuan Pasal 30 ayat (3) Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana, perlu menetapkan Peraturan Pemerintah tentang Peran Serta Lembaga Internasional dan Lembaga Asing Nonpemerintah dalam Penanggulangan Bencana; Mengingat : 1. Pasal 5 ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945; 2. Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana (Lembaran Negara Republik Indonesia Tahun 2007 Nomor 66, Tambahan Lembaran Negara Republik Indonesia Nomor 4723); MEMUTUSKAN : Menetapkan : PERATURAN PEMERINTAH TENTANG PERAN SERTA LEMBAGA INTERNASIONAL DAN LEMBAGA ASING NONPEMERINTAH DALAM PENANGGULANGAN BENCANA. BAB I . . . - 2 - BAB I KETENTUAN UMUM Pasal 1 Dalam Peraturan Pemerintah ini yang dimaksud dengan: 1. Lembaga internasional adalah organisasi yang berada dalam lingkup struktur organisasi Perserikatan Bangsa-Bangsa atau yang menjalankan tugas mewakili Perserikatan Bangsa-Bangsa atau organisasi internasional lainnya. 2. Lembaga asing nonpemerintah adalah suatu lembaga internasional yang terorganisasi secara fungsional bebas dari dan tidak mewakili pemerintahan suatu negara atau organisasi internasional yang dibentuk secara terpisah dari suatu negara di mana organisasi itu didirikan. 3. Penyelenggaraan penanggulangan bencana adalah serangkaian upaya yang meliputi penetapan kebijakan pembangunan yang berisiko timbulnya bencana, kegiatan pencegahan bencana, tanggap darurat, dan rehabilitasi. 4. Badan Nasional Penanggulangan Bencana yang selanjutnya disingkat dengan BNPB adalah lembaga pemerintah nondepartemen sesuai dengan ketentuan peraturan perundang-undangan. 5. Instansi/lembaga yang terkait adalah instansi/lembaga yang terkait dengan penanggulangan bencana. Pasal 2 Peran serta lembaga internasional dan lembaga asing nonpemerintah dalam penanggulangan bencana bertujuan untuk mendukung penguatan upaya penanggulangan bencana, pengurangan ancaman dan risiko bencana, pengurangan penderitaan korban bencana, serta mempercepat pemulihan kehidupan masyarakat. Pasal 3 . . . - 3 - Pasal 3 Pengaturan mengenai peran serta lembaga internasional dan lembaga asing nonpemerintah dalam penanggulangan bencana meliputi kegiatan pada tahap prabencana, saat tanggap darurat, dan pascabencana. Pasal 4 Kepala BNPB berwenang menentukan peran serta lembaga internasional dan lembaga asing nonpemerintah dalam penanggulangan bencana. BAB II TATA CARA PERAN SERTA LEMBAGA INTERNASIONAL DAN LEMBAGA ASING NONPEMERINTAH Pasal 5 (1) Lembaga internasional atau lembaga asing nonpemerintah yang akan berperan serta dalam penanggulangan bencana harus menyusun: a. proposal; b. nota kesepahaman; dan c. rencana kerja. (2) Proposal sebagaimana dimaksud pada ayat (1) huruf a disusun oleh lembaga internasional atau lembaga asing nonpemerintah melalui konsultasi dengan perwakilan Republik Indonesia di luar negeri. (3) Nota kesepahaman sebagaimana dimaksud pada ayat (1) huruf b disusun secara bersama-sama antara BNPB dan lembaga internasional atau lembaga asing nonpemerintah dengan melibatkan instansi yang bertanggungjawab dalam bidang luar negeri. (4) Penyusunan nota kesepahaman sebagaimana dimaksud pada ayat (1) dapat dilakukan antara instansi/lembaga terkait dan lembaga internasional atau lembaga asing nonpemerintah dikoordinasikan oleh BNPB dengan melibatkan instansi yang bertanggungjawab dalam bidang luar negeri. Pasal 6 . . . - 4 - Pasal 6 (1) Rencana kerja sebagaimana dimaksud dalam Pasal 5 ayat (1) huruf c disusun secara bersama-sama antara BNPB dan lembaga internasional atau lembaga asing nonpemerintah dan dapat melibatkan instansi/lembaga terkait. (2) Penyusunan rencana kerja sebagaimana dimaksud dalam Pasal 5 ayat (1) huruf c yang dilakukan antara instansi/lembaga terkait dan lembaga internasional atau lembaga asing nonpemerintah dikoordinasikan oleh BNPB. Pasal 7 Pelaksanaan nota kesepahaman dan rencana kerja sebagaimana dimaksud dalam Pasal 5 dan Pasal 6 dikoordinasikan oleh BNPB. Pasal 8 (1) Pada saat tanggap darurat, lembaga internasional atau lembaga asing nonpemerintah dapat memberikan bantuan secara langsung tanpa melalui prosedur sebagaimana dimaksud dalam Pasal 5 dan Pasal 6. (2) Pemberian bantuan oleh lembaga internasional atau lembaga asing nonpemerintah sebagaimana dimaksud pada ayat (1) dilakukan dengan menyampaikan daftar jumlah personil, logistik, peralatan, dan lokasi kegiatan. (3) Penyampaian daftar jumlah personil, logistik, dan peralatan sebagaimana dimaksud pada ayat (2) dapat dilakukan sebelum, pada saat, atau segera sesudah bantuan tiba di Indonesia. (4) Berdasarkan daftar jumlah personil, logistik, dan peralatan sebagaimana dimaksud pada ayat (3), Kepala BNPB memberikan persetujuan sesuai dengan kebutuhan tanggap darurat bencana. (5) Kepala BNPB dalam melaksanakan ketentuan sebagaimana dimaksud pada ayat (4) berkoordinasi dengan instansi/lembaga terkait. (6) Dalam . . . - 5 - (6) Dalam hal lembaga internasional atau lembaga asing nonpemerintah memberikan bantuan berupa dana harus disampaikan atau dikirimkan secara langsung kepada BNPB. (7) Ketentuan mengenai bantuan dana sebagaimana dimaksud pada ayat (6) diatur sesuai dengan ketentuan peraturan perundangan-undangan. Pasal 9 Pelaksanaan pengerahan personil, logistik, dan/atau peralatan sebagaimana dimaksud dalam Pasal 8 ayat (2), ayat (3), dan ayat (4) mendapatkan kemudahan akses sesuai dengan ketentuan peraturan perundangundangan. BAB III PELAKSANAAN PERAN SERTA LEMBAGA INTERNASIONAL DAN LEMBAGA ASING NONPEMERINTAH Pasal 10 (1) Peran serta lembaga internasional atau lembaga asing nonpemerintah dalam kegiatan penanggulangan bencana pada tahap prabencana dan pascabencana wajib menyesuaikan dengan kebijakan penyelenggaraan penanggulangan bencana. (2) Peran serta lembaga internasional atau lembaga asing nonpemerintah sebagaimana dimaksud pada ayat (1) dikoordinasikan oleh BNPB. (3) Peran serta lembaga internasional atau lembaga asing nonpemerintah dalam penanggulangan bencana pada saat tanggap darurat berada di bawah komando BNPB. Pasal 11 (1) Para pekerja dari lembaga internasional atau lembaga asing nonpemerintah yang melakukan kegiatan penanggulangan bencana mendapat jaminan perlindungan dari Pemerintah. (2) Jaminan . . . - 6 - (2) Jaminan perlindungan sebagaimana dimaksud pada ayat (1) dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan. Pasal 12 (1) Lembaga internasional atau lembaga asing nonpemerintah dapat berperan serta dalam penanggulangan bencana secara sendiri-sendiri, bersama-sama, dan/atau bersama dengan mitra kerja dari Indonesia. (2) Lembaga internasional atau lembaga asing nonpemerintah yang memberikan bantuan secara lengkap berupa personil asing, logistik, dan/atau peralatan sebagaimana dimaksud dalam Pasal 8 dapat berperan serta dalam penanggulangan bencana secara sendiri-sendiri. (3) Lembaga internasional atau lembaga asing nonpemerintah yang memberikan bantuan tidak secara lengkap sebagaimana dimaksud pada ayat (2) dapat berperan serta dalam penanggulangan bencana secara bersama-sama untuk saling melengkapi dengan lembaga internasional atau lembaga asing nonpemerintah lainnya. (4) Lembaga internasional atau lembaga asing nonpemerintah sebagaimana dimaksud pada ayat (2) dan ayat (3) dapat berperan serta dalam penanggulangan bencana bersama dengan mitranya di Indonesia, baik dengan instansi/lembaga terkait maupun lembaga swadaya masyarakat yang memiliki kesamaan visi dan misi. Pasal 13 (1) Lembaga internasional atau lembaga asing nonpemerintah dalam kegiatan penanggulangan bencana sebagaimana dimaksud dalam Pasal 12 dapat diberi kemudahan. (2) Pemberian . . . - 7 - (2) Pemberian kemudahan sebagaimana dimaksud pada ayat (1) dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan. Pasal 14 (1) Lembaga internasional dan lembaga asing nonpemerintah yang berperan serta dalam penanggulangan bencana dilarang melakukan kegiatan yang berlatar belakang politik atau keamanan. (2) Dalam menentukan suatu kegiatan mengandung unsur politik atau keamanan sebagaimana dimaksud pada ayat (1), Kepala BNPB wajib berkoordinasi dengan badan yang tugas dan tanggung jawabnya di bidang intelijen dan keamanan. (3) Lembaga internasional dan lembaga asing nonpemerintah yang berperan serta dalam penanggulangan bencana, wajib memperhatikan dan menghormati latar belakang sosial, budaya, dan agama masyarakat setempat. BAB IV PENGAWASAN DAN PELAPORAN Pasal 15 (1) BNPB melakukan pengawasan terhadap peran serta lembaga internasional dan lembaga asing nonpemerintah dalam penanggulangan bencana. (2) Pengawasan sebagaimana dimaksud pada ayat (1) dilakukan untuk mengetahui aktivitas kegiatannya. (3) Ketentuan mengenai tata cara pengawasan sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Kepala BNPB. Pasal 16 . . . - 8 - Pasal 16 (1) Lembaga internasional dan lembaga asing nonpemerintah wajib menyampaikan laporan pelaksanaan kegiatannya yang akuntabel kepada BNPB, yang dilakukan secara periodik, pada akhir masa tugasnya atau sewaktu-waktu jika diminta oleh BNPB. (2) Laporan sebagaimana dimaksud pada ayat (1) diumumkan oleh BNPB kepada publik secara transparan. (3) Ketentuan mengenai tata cara pelaporan dan substansi laporan sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Kepala BNPB. BAB V KETENTUAN LAIN-LAIN Pasal 17 (1) Dalam hal bantuan untuk penanggulangan bencana berasal dari negara asing, Kepala BNPB wajib berkonsultasi dan berkoordinasi dengan menteri yang tugas dan tanggung jawabnya di bidang luar negeri. (2) Ketentuan sebagaimana dimaksud pada ayat (1) dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan. BAB VI KETENTUAN PENUTUP Pasal 18 Peraturan Pemerintah ini mulai berlaku pada tanggal diundangkan. UMUM Pengaturan peran serta lembaga internasional dan lembaga asing nonpemerintah dalam penanggulangan bencana di Indonesia di samping bertujuan untuk mendukung penguatan upaya penanggulangan bencana, pengurangan ancaman dan risiko bencana, pengurangan penderitaan korban bencana, dan mempercepat pemulihan kehidupan masyarakat, juga dimaksudkan untuk: 1. menjamin penghormatan terhadap peran dan tindakan Pemerintah berdasarkan kepentingan masyarakat sebagai penanggung jawab utama dalam mengatur dan mengkoordinir kegiatan penanggulangan bencana; 2. memungkinkan masyarakat internasional memberikan dukungan dan kontribusi secara efektif dalam kegiatan penanggulangan bencana; 3. memperjelas proses, peran, dan tanggung jawab Pemerintah dan komunitas internasional dalam kegiatan penanggulangan bencana; 4. meminimalisasi hambatan-hambatan administrasi dan hukum yang dapat mempengaruhi efektivitas dan efisiensi pemberian bantuan internasional dalam situasi darurat; dan 5. menjamin kerjasama dan bantuan internasional yang diberikan sesuai dengan prinsip-prinsip kemanusiaan dan kualitas standar baik secara nasional maupun internasional. Peran . . . - 2 - Peran serta lembaga internasional dan lembaga asing nonpemerintah dalam penanggulangan bencana di Indonesia harus didasarkan pada prinsip-prinsip sebagaimana dimaksud dalam Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana. Dan juga harus didasarkan pada Undang-Undang Nomor 37 Tahun 1999 tentang Hubungan Luar Negeri dan Undang-Undang Nomor 24 Tahun 2000 tentang Perjanjian Internasional. Lembaga internasional dan lembaga asing nonpemerintah wajib menghormati kedaulatan Negara Kesatuan Republik Indonesia, menempatkan prinsip kemanusiaan sebagai satu-satunya tujuan, menjamin bahwa bantuan yang diberikan tanpa membedakan suku, agama, latar belakang budaya, sosial, ekonomi, politik, dan jenis kelamin, sesuai dengan hukum yang berlaku dalam koordinasi dan keterpaduan yang baik dengan Pemerintah, pemerintah daerah, lembaga internasional dan lembaga asing nonpemerintah yang lain, mitra kerja Pemerintah dan masyarakat; dilandasi oleh kompetensi yang baik di bidang kelembagaan dan pekerja yang diakui secara nasional dan internasional; mengikuti mekanisme yang berlaku di Indonesia dan melibatkan masyarakat korban bencana serta mitra kerja dalam penanggulangan bencana dengan baik; dan sesuai dengan hukum internasional dan nasional yang berlaku termasuk hukum hak asasi manusia dan kemanusiaan. Lembaga internasional dan lembaga asing nonpemerintah dalam menjalankan perannya di Indonesia juga harus memenuhi standar kualitas minimal yang berlaku secara nasional, melibatkan masyarakat korban bencana mulai dari tahap perencanaan, implementasi, monitoring, dan evaluasi program, tidak membawa dampak negatif bagi kehidupan, kelembagaan ekonomi, sosial, dan budaya masyarakat, tidak melewati batas kadaluarsa dari suatu jenis bantuan yang diberikan, tidak mengaitkan dengan kepentingan politik, ideologi, dan agama tertentu, dan bukan sebagai alat kebijakan dari pemerintah asing tertentu. Dalam rangka memaksimalkan seluruh sumber daya yang ada khususnya yang berasal dari luar negeri, Pemerintah: 1. memiliki tanggung jawab utama dalam memberikan atau mengatur upaya pengurangan risiko bencana, pertolongan dan bantuan pemulihan di wilayah Negara Kesatuan Republik Indonesia; 2. mempunyai . . . - 3 - 2. mempunyai hak penuh untuk mengkoordinasikan, memonitor, dan mengatur sesuai dengan prinsip-prinsip kemanusiaan dan hukum international, pertolongan bencana dan bantuan pemulihan yang diberikan oleh para pemberi bantuan di wilayah Negara Kesatuan Republik Indonesia; 3. menjamin bahwa prosedur yang diperlukan sudah disiapkan guna memfasilitasi penyampaian informasi tentang bencana alam secara cepat, termasuk informasi tentang bencana yang akan timbul, bila perlu bersama-sama dengan negara atau organisasi internasional lain termasuk Kantor Koordinator Bantuan Darurat Perserikatan Bangsa-Bangsa; 4. memberikan informasi yang tepat kepada masyarakat internasional mengenai peraturan perundang-undangan dalam negeri yang sangat relevan dengan kedatangan dan pelaksanaan kegiatan penanggulangan bencana; 5. menyediakan sebuah sistem yang jelas dan berlaku dalam berkoordinasi dengan masyarakat internasional bagi semua kegiatan penanggulangan bencana; 6. menjamin terpenuhinya kebutuhan para korban bencana dengan mencari atau menerima bantuan dari masyarakat internasional bila situasi bencana melampaui kemampuan Pemerintah untuk mengatasinya; 7. memberikan perlindungan terhadap pekerja, bangunan, arsiparsip dan peralatan komunikasi yang digunakan oleh lembaga internasional dan lembaga asing nonpemerintah dalam kegiatan penanggulangan bencana; dan 8. menjamin lembaga internasional khususnya badan-badan, pendanaan, program, pekerja dan barang-barang milik Perserikatan Bangsa-Bangsa, dapat memainkan perannya dalam penanggulangan bencana sesuai dengan Konvensi Perserikatan Bangsa-Bangsa tentang Hak-Hak Istimewa dan Kekebalan. The disaster tackling implementation efforts is a series effort that covers the development policy validation that has the risk to the appearance of the disaster, the disasrter prevention activities, the emergency alert, and rehabilitation. 4. The Disaster Tackling National Board that later will be called with BNPB is the non department government institution appropriate with the regulation determination. 5. The related institution is the institution that related with the disaster tackling. Clause 6 (1) The working plan as it meant in the Clause 5 article (1) c alphabet is arranged altogether between the BNPB and the international or the non government foreign institutions and can involve the related institution. (2) The working plan arrangement as it meant in the Clause 5 article (1) that can be done between the related institution and the international or the non government foreign institution that coordinated by the BNPB. Clause 7 The agreement note implementation and the working plan as it meant in the Clause 5 and 6 has been coordinated by the BNPB. Clause 8 (1) In the situation of the emergency alert, the international or the non government foreign institution can distribute the aid assistance directly through the procedure as it meant in the Clause 5 and Clause 6. (2) The aid assistance distribution by the international or the non government institution as it meant in the article (1) is implemented by sending the list of the personnel amount, logistic, tools, and the activities location. (3) The list of the personnel amount, logistic, tools, and the activities location distribution as it meant in the article (2) is implemented before, in the meantime, or after the aid assistance arrival in Indonesia. (4) Based on the personnel amount, logistic, and the tools as meant on the article (3), the head of the BNPB can give the agreement appropriate with the demand of the disaster emergency alert. (3) The international and the non government institutions has the role disaster tackling, also must the pay attention and to respect the social background, culture, and the religion of the local society. CHAPTER IV THE SURVEILLANCE AND REPORT Clause 15 (1) BNPB is doing the surveillance to the role of the international and the non government foreign institutions in disaster tackling. (2) The surveillance as it meant in the article (1) is made to know the ativities. (3) The determination about the surveillance way as it meant in the article (1) is managed in the head of the BNPB regulation. Clause 16 (1) The international and the non government foreign institutions is obligate to report the activities implementation report that has the accountability to the BNPB, periodically, in the end of the duty or sometime if it asked by the BNPB. (2) The report as it meant in article (1) is announced by the BNPB to the public transparently. (3) The determination about the way of reporting and the substance of the report as it meant in article (1) is arranged with the head of the BNPB regulation.
