Source text - English Right to Recision. If you wish to cancel this Contract, you must send certified mail, return receipt requested to: XXXXXX. The notice must say that you do not wish to be bound by the Contract and must be mailed before midnight of the third business day after you sign this Contract. The Member shall include with such a notice any contracts, membership cards or any other documents or evidence of membership previously delivered to Member. The Contract may also be canceled if XXX moves or goes out of business and fails to provide alternative facilities within five miles of the location designated in this Contract. Once canceled, you will get a full refund of the unused portion of your membership under this Contract and will no longer be obligated to any future payments.
This Contract is not cancelable and is not transferable for any reason whatsoever, except as herein provided; and no subsequent modification of the Contract may be made except in a written agreement by all parties.
Failure of the Member to utilize the facility of XXX for any reason shall not relieve the Member from the obligation to make any payment required to be made by the Member pursuant to the Contract.
Translation - Spanish Derecho de rescisión. En caso de que desee cancelar el presente Contrato, debe enviar un correo certificado con acuse de recibo a: XXXXXX. La notificación debe indicar que usted no desea estar vinculado al Contrato y se debe enviar antes de la medianoche del tercer día laborable siguiente al día en que firma el presente Contrato. El Miembro deberá incluir con dicha notificación todo contrato, tarjeta de membresía o cualquier otro documento o prueba de la membresía que se le haya enviado al Miembro con anterioridad. También se puede cancelar el Contrato, en caso de que XXX se mude o cese sus actividades comerciales y no pueda proporcionar instalaciones alternativas dentro de las cinco millas de la ubicación designada en el presente Contrato. Una vez cancelado, usted recibirá un reembolso completo de la parte de su membresía que no utilizó en virtud del presente Contrato y no estará obligado a ningún pago posterior.
Este Contrato no se puede cancelar ni transferir por ninguna razón, salvo lo dispuesto en el presente; además, no se podrá realizar ninguna modificación subsiguiente del Contrato excepto mediante un acuerdo por escrito entre todas las partes.
El incumplimiento del Miembro de no utilizar las instalaciones de XXX por cualquier razón no eximirá al Miembro de la obligación de efectuar algún pago que se le requiera realizar de conformidad con el Contrato.
