agree kashew : But only perfectly clear if both terms are present side-by-side.

Side-by-side in the beginning of the contract...
disagree Fabian Deckwirth : Plain wrong. A muscle is contracted, not a party. Principal and Service Provider are an example for a correct translation.

contractor and contractee

Exemplo:
Among NGOS, it is often unclear if the relationship is that of donor and grantee, contractor and contractee, or a partnership.

No entanto também concordo com as outras respostas. Todas as opções dizem a mesma coisa.
Peer comment(s):

agree Ward Whittaker : Both these answers are correct. It just comes down to style and nothing more, although I use contractor and contractee more. Contractee gives 991,000 hits in google and contracted party only 27,000.

disagree Fabian Deckwirth : Contractor is actually contratada, and contractee is contratante.

First party and second party

While I agree that contracting party and contracted party is perfectly correct, I think the simpler 1st and 2nd parties is more frequent and natural, at leat to my ear
Peer comment(s):

neutral kashew : Equally fuzzy! It doesn't work as clearly as employer(ee) does it?
