2.6 Czy istnieją silniejsze i słabsze środki dowodowe?
Brak jest podstaw do przyjęcia formalnej hierarchii środków dowodowych z punktu widzenia ich wiarygodności i mocy w oderwaniu od konkretnego stanu faktycznego. Zasadą jest, że sąd dokonuje oceny dowodów według uznania (art. 233 kpc). W swej ocenie powinien brać pod uwagę zasadę z art. 246 i 247 kpc, o wyższości dowodu z dokumentu nad dowodem z przesłuchania świadków lub stron.

Postępowanie przed komisją wydaje się zwiększać szanse uznania podejrzanego za winnego. O ile bowiem zgodnie z powszechnym prawem karnym wina musi być oparta na jasnym i przekonującym dowodzie (clear and convincing), to w postępowaniu uniwersyteckim o winie można zadecydować w drodze tzw. wyższości dowodu (preponderance of evidence).

A requirement that more then 50% of the evidence points to something. This is the burden of proof in a civil trial.
For example: At the end of civil case A v. B, 51% of the evidence favors A. Thus, A has a preponderance of the evidence, A has met their burden of proof, and A will win the case.

This preponderance is based on the more convincing evidence and its probable truth or accuracy, and not on the amount of evidence. Thus, one clearly knowledgeable witness may provide a preponderance of evidence over a dozen witnesses with hazy testimony, or a signed agreement with definite terms may outweigh opinions or speculation about what the parties intended. Preponderance of the evidence is required in a civil case and is contrasted with "beyond a reasonable doubt," which is the more severe test of evidence required to convict in a criminal trial. No matter what the definition stated in various legal opinions, the meaning is somewhat subjective.

In most civil cases/lawsuits as well as administrative hearings, a party must prove its claim or position by a preponderance, defined as a superiority in weight, force, importance, etc. In legal terms, a preponderance of evidence means that a party has shown that its version of facts, causes, damages, or fault is more likely than not the correct version, as in personal injury and breach of contract suits. This standard is the easiest to meet and applies to all civil cases unless otherwise provided by law.
