We need the wording ... of Art 5. You kind of get the feeling they might have meant to say "gleichwohl". Perhaps something like "at the same time". Depends.

agree TonyTK : Still not quite sure, but this looks likely. Hence my "at the same time" suggestion" - which has a slight contrasting note but has the advantage of being vague.
