The regulation enacted in 1993 on prohibitions and restrictions on the marketing of dangerous substances, preparations and products under the Chemicals Act (Prohibited Chemicals Regulation – German designation: Chemikalien-Verbotsverordnung, ChemVerbotsV), currently valid in the version published on 13 June 2003 (Federal Law Gazette I p. 867), last amended by Article 5(40) of the Act of 24 February 2012 (Federal Law Gazette I p. 212), firstly governs prohibitions and restrictions on the marketing of specific substances, mixtures and products listed in an Annex. Secondly, it standardises general requirements to be observed when specific marketable substances and mixtures generally marked as chemicals are supplied to third parties, such as for example requirements regarding supplier expertise, keeping a supply log and distribution type (self-service, mail order).

These provisions, the core of which involves recording information on these substances in a supply log and a prohibition on mail order selling to private individuals, have been taken over by the more stringent provisions of Regulation (EU) No 98/2013, which inter alia prohibits the supply of five of the public and also prohibits the related importation, possession and use thereof. In the context of Regulation (EU) No 98/2013, the special provisions of the ChemVerbotsV now constitute the use of a national exemption power for these substances and therefore do not increase but rather reduce the protection of public safety from the misuse of these substances. Their exclusion from the scope of application of the supply provisions thus represents a tightening of the regulations applicable to them in Germany.
