Dans le cas présent, on ne connaît pas la nature précise des "charges" (endettement hypothécaire, créances privilégiées, etc.) c'est la raison nous suggérons d'utiliser l'expression "être grevée de..." et le mot passif, au sens général.

Charges

Next in the Charges Register you will find details of any financial charges (mortgages) registered against the property. These are listed in order of priority, that is to say that that in the event of the property being sold and there being insufficient equity to satisfy all charges (for example if the property were to be repossessed) the holder of the first charge is entitled to be repaid in full before any monies are paid to the holder of the second charge, and so on.

The entry for a charge will appear in two sections, as in our example. The first section gives the date of registration of the charge, tells us that it is a registered charge, and gives the date it was created (this will be the date of completion of the purchase/remortgage).The next section gives details of the chargee. The level of priority of a charge is dictated by the order which it appears in the register - the first entry having the highest priority and so on. It is of course imperative therefore when acting for a lender that their charge is properly registered.

There are certainly other types of "charges" but the ONLY kind of "charges" related to debts that appear in the Land registry are financial charges i.e. mortgages
