None of the research countries have a legal basis for either police referral or diversion schemes, with the exception of Afghanistan. In Afghanistan, the new Counter Narcotics Law prescribes that the Counter Narcotics Police should refer the offender with relevant documents, and evidence, to the Prosecutor’s Office (so that it may initiate referral) or, if a person has a certificate from a doctor confirming his/her drug addiction, the police can refer the person to a treatment centre directly. Such opportunities for diversion by the police or Prosecutor’s Office are unique within the region. Police diversion and referral schemes help low-threshold drug policing and reduce the burden to the criminal justice and court systems. This can also help to the police, prosecutors and courts to focus on high profile drug-related crimes and their investigation.
