What is an unclaimedsuccession?
A succession (estate) is unclaimed whenno successor* is known or claims it, orwhen all successors sign a renunciation inthe presence of a notary or make a judicialdeclaration to this effect.* A successor is a person entitled to inherit. Anheir is a successor who accepts the heritageto which he or she is entitled.Why renouncea succession?The usual reason for renouncing a succession(estate) is that its debts are greater than its assets.However, under the new Civil Code of Québec,the heirs’ liability for the debts of a succession islimited to the value of the property they receive.What is the time limit forrenouncing a successionThe Civil Code of Québec gives successors amaximum of six months to make an inventoryof a succession. They then have an additional 60days to renounce it.
