Dłużnik może wnieść powództwo na podstawie art. 840 § 1 pkt 1 k.p.c. niezależnie od tego, czy skarżył postanowienie o nadaniu klauzuli wykonalności, choćby można było w drodze zaskarżenia tego postanowienia podnieść te same zarzuty.
Nie stoi temu na przeszkodzie merytoryczny charakter obrony przed egzekucją, jaką daje dłużnikowi powództwo z art. 840 § 1 pkt 1 k.p.c.
Mam problem z tym ostatnim zdaniem.
